Membership Agreement

ATTENTION: PLEASE READ THE FOLLOWING TERMS OF AGREEMENT RELATING TO YOUR HearUSA HEARING AID BATTERY CLUB MEMBERSHIP. By enrolling in the HearUSA Hearing Aid Battery Club, you (hereinafter referred to as "the member") agree to the terms of the agreement explicitly thereof.

Scope of Agreement

This Membership Agreement (hereinafter referred to as "Agreement") is by and between HearUSA a Delaware Corporation (hereinafter referred to as "HearUSA") and the member.

Agreement

  • Confidentiality.
    • Any and all information collected for the purposes of membership, including but not limited to, transaction processing and shipping, shall:
      • be collected in a manner imploring the highest levels of security available,
      • only be used to support and faciliate your relationship with HearUSA,
      • only be shared with our financial service providers' to faciliate credit decisions, and
      • not be shared, sold, rented, or leased to any third-party.

  • Terms and Termination.
    • This Agreement shall commence on the date membership is completed and/or submitted, whether electronic or printed hardcopy.
    • Amendments to these terms, whether in exclusion or inclusion, must be made available for review tex (10) days prior to the effective date expressed therein.
    • Either party may terminate this Agreement without cause by giving the other party fifteen (15) days advance written notice.
    • Either party may terminate this Agreement upon fifteen (15) days written notice to the other party in the event the other party breaches this Agreement and fails to cure the breach within the fifteen (15) day notice period.

  • Billing.
    • The default credit card on file will be charged according to the frequency designated within the member profile for the amount of the standard order with associated products shipped upon credit approval.
    • If for any reason the default credit card on file declines the current amount due, the member status will be changed to "Suspended."
      • The member will be contacted to inform them of the credit decision issued by our financial service providers' and to obtain a usable credit card for billing.
        • If a usable credit card is not obtained, the membership will be terminated according to the process outlined in Section 2: Term and Termination.
        • If a usable credit card is obtained and credit approval received, the member status will be restored to "Active."

  • Member Profile.
    • It is the member's responsibility to insure all information contained within their member profile is accurate.
      • Updates to the member profile can be made either by logging into www.hearingaidbatteries.com or by calling toll-free (800) 432-7872.

  • Quality Guarantee.
    • Any and all products distributed by HearUSA as a part or in conjunction with the HearUSA Hearing Aid Battery Club are subject to the following quality assurance checks:
      • All products may be returned for any reason within thirty (30) calendar days from the date of purchase for a full refund less shipping charges.
      • Hearing aid batteries are guaranteed to be newer than the printed expiration period and received in a fully usable condition. If for any reason they are not fully usable, they may be exchanged for an identical replacement product.

  • General.
    • Products received from this membership shall not be used for resale purposes.
    • This Agreement contains a full and complete expression of the agreement of the parties, and it shall supersede all prior agreements, written or oral, heretofore made by either the member and/or HearUSA.
